A London florist has been ordered to pay compensation after being found guilty of negligence following an incident at Marylebone Station .
The station florist was taken to court after Brian Piccolo from Witham, Essex, slipped on a petal and fell forwards onto his right hand and then his right knee in March 2003.
The High Court had previously ruled that Chiltern Flowers was negligent in failing to have a "reasonably effective and safe system for dealing with the danger of fallen petals".
Despite appealing to the decision, the Court of Appeal said that although Mr Piccolo was aware of the presence of the flower display on the station concourse, "there was no reason why, as he walked by, he should have been looking down at his feet in order to avoid slippery petals".
The judge said that station officials had told the flower shop in the past to keep its frontage clean and had threatened to revoke its concourse licence if it failed to comply.
The florist is still awaiting the decision by the court on the amount of compensation it is required to pay .
